The current Terms and Conditions (“Terms”) define the terms of the Viewjoo mobile app/application and connected features, tools, and services (collectively called the “Platform”) access, usage, and interaction. In any way accessing, browsing, registering, or using the Platform, whether as a guest, a registered user, or a business, you confirm that you have read, understood, and agree to be legally bound by these Terms.

These Terms and Conditions establish a binding agreement between you and Viewjoo, and they apply to all users; individuals, companies, and service providers, as well as any other entity that accesses the Platform, are included. If you do not agree with any of the Terms you do not get access to use this platform.

Viewjoo has all the rights to the sole decision to alter, change, update, modify, or even substitute to complete the Terms and conditions anytime. Your use of the Platform after any alterations will be interpreted as your acceptance of the new Terms.

About Us

Viewjoo is a digital search and listing platform that helps users to easily find, discover and connect with businesses/brands and service providers across different categories and nationwide locations. The platform allows users to specify their location, the services to be displayed, and the businesses to be compared at the same time. Moreover, users can have access to detailed business information structured properly.

In addition, Viewjoo has a feature where users can book slots of services/offerings of service providers that opt for it. It enables the users to directly make requests for appointments or service timings through our platform.

Viewjoo only plays the role of informant and booker and does not have any ownership over, nor does it operate, manage, or control the businesses listed. The platform merely acts as a middleman bringing together users and third-party businesses for information and scheduling bookings.

Scope of Services

Viewjoo offers an online platform that gives users the opportunity to find, explore and book slots with companies/brands/service providers in various categories and at different places throughout the country. Only the services of discovery, information display, and booking facilitation are provided using our Platform.

The range of services provided by Viewjoo includes but is not limited to:

1. Users can search for businesses/services/offering according to their preferred location, category, and service
2. Business profiles displaying descriptions, images, contact information, hours of operation, and available services may be included
3. Businesses can list their services and control their visibility on the Platform
4. Where applicable, users can select a booking slot or request an appointment with the business
5. Comparison of multiple businesses within the same category is allowed for users to make an informed decision

Important Note: Viewjoo does not offer the actual services that are listed on the Platform and does not make any guarantees regarding the quality, availability, pricing, or outcome of any service. Third-party businesses provide all the services and Viewjoo's role is merely that of an informational and facilitative intermediary.

No Payment Processing

a) It is important to understand that Viewjoo acts as a middleman and is not responsible for the quality of the services provided by the service provider. Kindly also note that We do not collect, process or facilitate any kind of payment/transaction through/on our platform.

b) In case a user has to do or carry any kind of payment process, it will be done directly to the respective business/company/service provider. Viewjoo will not be held responsible for any kind of payment dispute, billing faults, refunds, cancellitations or pricing disagreements.

User Eligibility

a) The Viewjoo Platform is accessible and usable only by those individuals or entities who are legally able to conclude a binding contract according to the laws in force. By accessing or using the Platform you state and guarantee that you fulfill all the eligibility criteria given here.

b) If you want to use Viewjoo as a single user, then you must have reached the minimum age of eighteen (18) or the age of majority defined under the law of your country, whichever is higher. All those below that age limit are not allowed at all to register, to surf the site or to use it in any way. By your continued use of the Platform, you are confirming that all the information you have provided about yourself, including your age and identity, is correct and honest.

c) In case you are accessing or using the Platform for a business, brand, company, or any other legal entity, you actually represent and warrant that you are properly authorized to do so and to make the entity accept these Terms and Conditions. Besides, you imply that the business has complied with all local, national, and international laws, regulations, and licenses that apply to it in connection to the services it provides.

d) Viewjoo has the right to check the users' eligibility at any time, and if any eligibility condition is found to be violated or misrepresented, it may suspend or terminate access to the Platform without giving any notice.

User Accounts

a) In some cases, access to the features of Viewjoo might require users to create an account and ask them to maintain it. Users during registration agree to enter true, current and considerable information as requested and also to keep that information up to date at all times. Viewjoo has the right to suspend/close accounts that have been created using incorrect, deceptive, or incomplete information.

b) Every user is responsible for the confidentiality of their account credentials, which comprise usernames, passwords, and other details for logging into the account. All actions done through a particular user's account will be treated as having been done by the holder of that account. In such a case, Viewjoo won't be responsible for any loss, damage, or unauthorized activity that may occur when a user does not secure their account credentials properly.

c) Users are required to inform Viewjoo immediately if there is any unauthorized access, suspected breach, or misuse of their account. We have all the rights to limit, suspend, or close accounts that breach these Terms or put platform security at risk.

Business Listings

a) Viewjoo permits the utilization of the Platform for the creation and exhibition of listings by companies, their brands, and service providers to enhance their visibility and facilitate user finding. All the data entered by the businesses, for example business names, descriptions, categories, services offered, images, contact details, operating hours, booking availability, etc., is solely supplied by the respective company and it is their responsibility to manage it.

b) Businesses make a declaration, and their warranty is that all such information regarding the listing is accurate, complete, legal, and not misleading. Viewjoo does not check, audit, or recommend any business listings and does not make any guarantees concerning the quality, availability, pricing, or legality of the services being offered. The mere presence of a business on the platform neither means that Viewjoo recommends nor approves it.

c) Without any prior notice or liability, Viewjoo reserves its right to alter, halt, or even erase listings from its platform that violate these Terms, the applicable law, or the policies of the platform.

Booking Services

a) By using Viewjoo, all the users can check out and request the booking slots or appointment times that the businesses listed on the platform offer. The booking option is offered only at each business's discretion and is a way of making appointments between the users and the service providers. Viewjoo does not, in any way, affirm, assure, or oversee the posting of any booking slot visible on the platform.

b) The business is the one that accepts, changes, or even cancels every booking done via Viewjoo. The user is responsible for all communication, alterations, delays, and the like regarding the service and must interact directly with the business. Viewjoo will not be involved in nor be responsible for any of the booking confirmations, service provisions, or disputes that may arise.

User Obligations

The Viewjoo Platform users commit themselves to using the services responsibly, lawfully, and in compliance with these Terms as well as all relevant laws and regulations. The users will not resort to any misuse of the Platform that could lead to its disruption, security being forgiven, or other users or even businesses suffering from negatives. For instance, users should not submit false, misleading, or inaccurate information. They are requested to not use the Platform without authorization or use it for fraudulent or illegal purposes.

Users are also not allowed to defame, physically harm, threaten or make defamatory remarks about other users, service providers, or businesses. If such behavior occurs, the user’s account will be suspended or permanently terminated without prior notice.

Intellectual Property

All the intellectual property rights related to the Viewjoo Platform, such as trademarks, logos, brand names, software, interface design, text, graphics, and other content, are either owned by Viewjoo or licensed to it. The usage of these materials is subject to the respective intellectual property laws that protect them.

The users can only access and use the Platform for personal and legal purposes with a limited, non-exclusive, and non-transferable right. No activity can be done with the Platform without Viewjoo's prior written consent, such as copying, reproducing, modifying, distributing, transmitting, or any commercial exploitation. Furthermore, the violation done through unauthorized use of the Platform’s intellectual property may lead to legal actions and the ending of access.

User Generated Content

The Viewjoo Platform might let individuals and companies contribute content such as text, images, reviews, ratings and all kinds of other materials. The moment you offer content of this kind, you give Viewjoo a non-exclusive, worldwide, royalty-free, and transferable license that allows for content to be used, reproduced, displayed, distributed, and promoted in connection with the Platform.

You guarantee and disclaim any defects in that you own or hold the required rights, permissions, and authority to submit the content and that such content does not go against any third-party rights or breach laws. Viewjoo has the right to delete, change, or limit access to any content created by a user that goes against these Terms or platform policies, to do so without giving prior warning, and to do so without being liable.

User Reviews and Feedback

Viewjoo is a platform that permits its users to write and rate their experiences concerning companies that are part of the platform. Others can use these comments to make a decision. Viewjoo does not check, approve, or back up the reliability or accuracy of any review made by a user.

Viewjoo claims that any reviews that contain abusive language, false claims, or promotional content or are irrelevant may be removed. Viewjoo is not going to be held accountable for any user or business that relies on reviews or ratings, and all the disputes must be settled by the concerned parties directly.

Third Party Services

It is to be informed that this platform may or may not contain any third-party link. These third-party services are not handled by us. Be sure that the inclusion of these services or links is not approved by or related to us.

We will not be held responsible for the content, reliability, policies or availability of any third party services. You can access any third party services at your own risk. Viewjoo will not be responsible for any kind of loss, fraud, or dispute between you and third party services.

Privacy

The use of our platform is governed by our Privacy Policy that contains your personal information. When you start using our platform, you agree that we can collect your data and process it for Privacy Policy requirements.

Although we take responsible measures to protect your data, we are not responsible for providing absolute responsibility. Users are requested to maintain their confidentiality. We also update or make changes to our Terms and Conditions or Privacy Policy from time to time.

Platform Availability

We make sure our services remain available as well as functional at the same time. We also do not guarantee uninterrupted services. The use of the platform can be temporarily discontinued at the times of maintenance or technical issues.

We have all the rights to modify, suspend and discontinue any module of the platform without notifying. We are not liable for any kind of loss or damage due to temporary discontinuation of our services.

Account Suspension

We have all the rights and reservations to suspend, restrict or terminate your platform access anytime we want. These actions will not be taken if a user violated our Privacy Policy and Terms and Conditions or misused our platform.

These account suspensions can delete your account and content or any related data. We are not liable for the termination of access.

Disclaimer of Warranties

Our services are offered on an “as is” or “as available” basis. We do not provide any guarantee or warranties of any kind (e.g., reliability, suitability, or operational) on our platform.

We reject all warranties. Therefore, users acknowledge that the use of the Viewjoo Platform is at their own risk, and we do not provide any outcome or service quality.

Limitation of Liability

We are not responsible for any kind of direct, indirect, incidental, special, or punitive damage related to the use of our platform. This includes but is not limited to loss of data, business opportunities, and disputes between users and businesses.

We are not held responsible for the actions, omissions, or services of businesses listed on our platform. Any claim and dispute regarding services will stay between the users and the service provider.

Indemnification

Users agree to protect and defend Viewjoo and associated members of Viewjoo from and against any claim, damages, losses, costs, and expenses from your use of our platform. This claim of damage refers to your violation of these terms, misuse of the platform, submission of content, or disputes with businesses or other users. Not adhering to this can result in account suspension or termination.

Modification to Services

Users are hereby notified that we change/modify and enhance our features on the platform. These modifications occur for technical, legal and business reasons. Therefore, we will not be held responsible for suspension or discontinuation of any service. Accept these modifications or updates to use the platform without any issue.

Governing Law

These terms and conditions are made according to the Laws of India without contravening any law. Also know that any problem arising with the use of our Platform can be handled by Indian jurisdiction. These issues will be handled in the Court of India.

By agreeing to our Terms and Conditions, users agree to be taken to Indian Court in any illegal matters.

Severability

Should any section of these Terms be ruled by a legally authorized court as invalid, illegal, or unenforceable, then such section shall be cut off from the rest of the Terms. The rest of the sections would then be valid, enforceable, and binding to the maximum extent that the law allows.

Not enforcing any provision will not mean that Viewjoo waives its rights with regard to that provision or any other.

Entire Agreement

These Terms and Conditions and Privacy Policy, along with other policies on the platform, represent the agreement about the use of the platform.

Make sure that there will be no cancellation/withdrawal that will be effective unless approved by us.
